Adulterated product (prodotto adulterato) (termine USA) [rif. pollame e derivati, NdR]

The term “adulterated” shall apply to any poultry product under one or more of the following circumstances:

(1) if it bears or contains any poisonous or deleterious substance which may render it injurious to health; but in case the substance is not an added substance, such article shall not be considered adulterated under this clause if the quantity of such substance in or on such article does not ordinarily render it injurious to health;

(2)(A) if it bears or contains (by reason of administration of any substance to the live poultry or otherwise) any added poisonous or added deleterious substance (other than one which is (i) a pesticide chemical in or on a raw agricultural commodity; (ii) a food additive; or (iii) a color additive) which may, in the judgment of the Secretary, make such article unfit for human food;

(B)if it is, in whole or in part, a raw agricultural commodity and such commodity bears or contains a pesticide chemical which is unsafe within the meaning of section 346a of this title;

(C)if it bears or contains any food additive which is unsafe within the meaning of section 348 of this title;

(D)if it bears or contains any color additive which is unsafe within the meaning of section 379e of this title: Provided, That an article which is not otherwise deemed adulterated under clause (B), (C), or (D) shall nevertheless be deemed adulterated if use of the pesticide chemical, food additive, or color additive in or on such article is prohibited by regulations of the Secretary in official establishments;

(3)if it consists in whole or in part of any filthy, putrid, or decomposed substance or is for any other reason unsound, unhealthful, unwholesome, or otherwise unfit for human food;

(4)if it has been prepared, packed, or held under insanitary conditions whereby it may have become contaminated with filth, or whereby it may have been rendered injurious to health;

(5)if it is, in whole or in part, the product of any poultry which has died otherwise than by slaughter;

(6)if its container is composed, in whole or in part, of any poisonous or deleterious substance which may render the contents injurious to health;

(7)if it has been intentionally subjected to radiation, unless the use of the radiation was in conformity with a regulation or exemption in effect pursuant to section 348 of this title;

(8)if any valuable constituent has been in whole or in part omitted or abstracted therefrom; or if any substance has been substituted, wholly or in part therefor; or if damage or inferiority has been concealed in any manner; or if any substance has been added thereto or mixed or packed therewith so as to increase its bulk or weight, or reduce its quality or strength, or make it appear better or of greater value than it is.

Any egg or egg product under one or more of the following circumstances—

(1) if it bears or contains any poisonous or deleterious substance which may render it injurious to health; but in case the substance is not an added substance, such article shall not be considered adulterated under this clause if the quantity of such substance in or on such article does not ordinarily render it injurious to health;

(2)(A) if it bears or contains any added poisonous or added deleterious substance (other than one which is (i) a pesticide chemical in or on a raw agricultural commodity; (ii) a food additive; or (iii) a color additive) which may, in the judgment of the Secretary, make such article unfit for human food;

(B) if it is, in whole or in part, a raw agricultural commodity and such commodity bears or contains a pesticide chemical which is unsafe within the meaning of section 346a of this title;

(C) if it bears or contains any food additive which is unsafe within the meaning of section 348 of this title;

(D) if it bears or contains any color additive which is unsafe within the meaning of section 379e of this title: Provided, That an article which is not otherwise deemed adulterated under clause (B), (C), or (D) shall nevertheless be deemed adulterated if use of the pesticide chemical, food additive, or color additive, in or on such article, is prohibited by regulations of the Secretary in official plants;

(3) if it consists in whole or in part of any filthy, putrid, or decomposed substance, or if it is otherwise unfit for human food;

(4) if it has been prepared, packaged, or held under insanitary conditions whereby it may have become contaminated with filth, or whereby it may have been rendered injurious to health;

(5) if it is an egg which has been subjected to incubation or the product of any egg which has been subjected to incubation;

(6) if its container is composed, in whole or in part, of any poisonous or deleterious substance which may render the contents injurious to health;

(7) if it has been intentionally subjected to radiation, unless the use of the radiation was in conformity with a regulation or exemption in effect pursuant to section 348 of this title; or

(8) if any valuable constituent has been in whole or in part omitted or abstracted therefrom; or if any substance has been substituted, wholly or in part therefor; or if damage or inferiority has been concealed in any manner; or if any substance has been added thereto or mixed or packed therewith so as to increase its bulk or weight, or reduce its quality or strength, or make it appear better or of greater value than it is.

Agricoltore

Alimenti pronti

I prodotti alimentari destinati al consumo umano diretto, senza che sia necessaria la cottura o altro trattamento per eliminare o ridurre a un livello accettabile i microrganismi presenti.

Alimento

(Sinonimi: «prodotto alimentare» o «derrata alimentare») Qualsiasi sostanza o prodotto trasformato, parzialmente trasformato o non trasformato, destinato ad essere ingerito, o di cui si prevede ragionevolmente che possa essere ingerito, da esseri umani.

Sono comprese le bevande, le gomme da masticare e qualsiasi sostanza, compresa l'acqua, intenzionalmente incorporata negli alimenti nel corso della loro produzione, preparazione o trattamento. Esso include l'acqua nei punti in cui i valori devono essere rispettati come stabilito all'articolo 6 della direttiva 98/83/CE e fatti salvi i requisiti delle direttive 80/778/CEE e 98/83/CE.

Non sono compresi:

a) i mangimi;

b) gli animali vivi, a meno che siano preparati per l'immissione sul mercato ai fini del consumo umano;

c) i vegetali prima della raccolta;

d) i medicinali ai sensi delle direttive del Consiglio 65/65/CEE e 92/73/CEE;

e) i cosmetici ai sensi della direttiva 76/768/CEE del Consiglio;

f) il tabacco e i prodotti del tabacco ai sensi della direttiva 89/622/CEE del Consiglio;

g) le sostanze stupefacenti o psicotrope ai sensi della convenzione unica delle Nazioni Unite sugli stupefacenti del 1961 e della convenzione delle Nazioni Unite sulle sostanze psicotrope del 1971;

h) residui e contaminanti;

i) i dispositivi medici ai sensi del regolamento (UE) 2017/745 del Parlamento europeo e del Consiglio.

Alimento a base di cereali

Prodotto alimentare:

i) destinato a soddisfare le esigenze specifiche dei lattanti in buona salute nel periodo di svezzamento e dei bambini nella prima infanzia in buona salute per integrarne la dieta e/o per abituarli gradualmente a un’alimentazione ordinaria; e

ii) appartenente a una delle seguenti categorie:

-- cereali semplici ricostituiti o da ricostituire con latte o con altro liquido nutritivo appropriato;

-- cereali con l’aggiunta di un alimento ricco di proteine, ricostituiti o da ricostituire con acqua o con altri liquidi non contenenti proteine;

-- pastina da utilizzarsi dopo cottura in acqua bollente o in altri liquidi adatti;

-- biscotti e fette biscottate da utilizzarsi tali e quali o dopo essere stati sbriciolati e uniti ad acqua, latte o altri liquidi adatti.

Alimento a fini medici speciali

Prodotto alimentare espressamente elaborato o formulato e destinato alla gestione dietetica di pazienti, compresi i lattanti, da utilizzare sotto controllo medico; è destinato all’alimentazione completa o parziale di pazienti con capacità limitata, disturbata o alterata di assumere, digerire, assorbire, metabolizzare o eliminare alimenti comuni o determinate sostanze nutrienti in essi contenute o metaboliti, oppure con altre esigenze nutrizionali determinate da condizioni cliniche e la cui gestione dietetica non può essere effettuata esclusivamente con la modifica della normale dieta.

Alimento a ridotto contenuto calorico

Alimento con contenuto calorico ridotto di almeno il 30 % rispetto all’alimento originario o a un prodotto analogo.

Alimento non trasformato

Alimento che non ha subito un trattamento che abbia determinato un mutamento sostanziale del suo stato iniziale; a questo riguardo, le seguenti operazioni non sono considerate come determinanti un mutamento sostanziale: divisione, separazione, scissione, disossamento, tritatura, scuoiatura, sbucciatura, pelatura, frantumazione, taglio, pulitura, decorazione, surgelazione, congelazione, refrigerazione, macinatura, sgusciatura, imballaggio o disimballaggio.

Alimento per la prima infanzia

Prodotto alimentare destinato a soddisfare le esigenze specifiche dei lattanti in buona salute nel periodo di svezzamento e dei bambini nella prima infanzia in buona salute per integrarne la dieta e/o per abituarli gradualmente a un’alimentazione ordinaria, a esclusione di:

i) alimenti a base di cereali; e

ii) bevande a base di latte e prodotti analoghi destinati ai bambini nella prima infanzia.

Alimento preconfezionato

Qualunque articolo proposto per la presentazione, consistente in un alimento e nell'imballaggio in cui tale alimento è stato condizionato prima di essere posto in vendita, contenente l'alimento sia completamente, sia soltanto in parte, ma comunque in maniera tale da impedire che il contenuto possa essere alterato se non aprendo o modificando l'imballaggio.
