On 25 May 2023, Regulation (EU) 2023/915 on maximum levels of contaminants in food entered into force. The text repeals and replaces Regulation (EC) No 1881/2006, maintaining its limits but reorganizing the structure.

Key innovations

The main innovation is a reorganization of the categories of contaminants, with more cross-references to Regulation (EC) No 396/2005. The text is also easier to read, with most footnotes removed and clearer rules on how limits apply to different foods.

For each category, Annex I specifies the relevant plant or animal-based foods subject to limits.

Marketing rules

Foods exceeding contaminant limits cannot be marketed or used as raw materials or ingredients. In addition, compliant foods cannot be mixed with products that exceed the threshold.

Regulation (EU) 2023/915 represents a step forward in clarity and regulatory harmonization, maintaining existing protection levels while making the rules more accessible to operators.
